Formal Complaint Council Code of Conduct

  1. Collection of Personal Information

    This information is being collected under the authority of Section 33(c) of the Freedom of Information and Protection of Privacy Act (FOIP Act) for the purposes of processing and acting upon your complaint, and if an investigation is conducted maybe disclosed to the respondent and investigator(s). This information will be collected, used, and disclosed in accordance with the FOIP Act.   2. Formal Complaint: Council Code of Conduct

    Under Town of Banff Code of Conduct Bylaw 429-1, any individual including a Member of Council, who has witnessed or experienced conduct by a Member of Council that they believe to be in contravention of the Bylaw may file a formal complaint in accordance with the following:

    1. All complaints shall be made in writing and shall be dated and signed by an identifiable individual;
    2. All complaints shall be addressed to the Town of Banff Investigator; and
    3. The complaint must set out reasonable and probable grounds, in detail, for the allegation.
  3. Under Bylaw 429-1, if the complaint includes one or more Member(s) of Council who are alleged to be responsible for the breach of the Code of Conduct Bylaw, the Member or Members, concerned shall receive a copy of this complaint. The Investigator may withhold the name of the person who submitted the complaint should they deem, it could be reasonably be expected to threaten the safety or mental, or physical health of the individual or interfere with public safety.

    Clearly outline in this section what the Member of Council is alleged to have done that you believe breaches the Code of Conduct Bylaw. If you are complaining about more than one Member of Council, you should clearly explain what each individual person has allegedly done.

    It is also important that you provide all the evidence that you wish to have taken into account in any decision as to whether to take any action on your complaint of not. For example:

    • You should be specific, wherever possible about exactly what you are alleging that the Member said or did and provide the specific sections of the Bylaw that have been contravened;
    • You should provide the dates of the alleged incidents wherever possible. If you cannot provide exact dates, it is important to give a general timeframe;
    • You should confirm whether there are any possible witnesses to the alleged conduct and provide their names and contact details if possible; and
    • You should provide any relevant background information or other relevant documentary evidence to support your allegation.
