Development Appeal Board Meeting

Thursday, January 19

The Development Appeal Board will hold a hearing on Thursday, January 19, 2017 at 9 a.m. in the Town Hall Council Chamber. This is a procedural meeting of the DAB as one of the appellants has requested that the matter be adjourned until February 23, 2017.

Take notice that the Development Appeal Board (DAB) will hold a hearing on Thursday, January 19, 2017 at 9 a.m. in the Town Hall Council Chamber located at 110 Bear Street, Banff, AB to hear the following appeals against a decision of the Development Authority to approve a 132 unit apartment housing building at 547 Deer Lane with a variance to allow for a shared amenity area, a minor variance to the minimum required front yard setback and a variance to reduce the minimum required off-street parking from 144 to 80 parking stalls in accordance with Policy C122 Residential Apartment Housing / Off-street Parking and Alternative Transportation Standards:

Appeal 07-16
Appeal by affected neighbours on grounds that the parking variance is not minor and contradicts the provisions of the Land Use Bylaw, that the application of Council Policy C122 is contrary to the Incorporation Agreement and that amount of visitor parking provided is inadequate for the proposed development.

Appeal 08-16
Appeal by affected an neighbour on grounds that the Development Authority (Municipal Planning Commission) did not approve the development in accordance with the provisions of the Land Use Bylaw and failed to decide upon the application in accordance with their duties and responsibilities.

Appeal 09-16
Appeal by affected neighbours on grounds that the Development Authority (Municipal Planning Commission) did not require a comprehensive landscape plan and failed to consider whether or not the proposed development is compatible with the surrounding districts in accordance with the provisions of the Land Use Bylaw.

Verbal presentations and written submissions to the Development Appeal Board may be made at the scheduled hearing. Written submissions to be included in the information packet provided to the DAB members prior to the hearing must be received by no later than 4:30 p.m. on Thursday, January 12, 2017. Written submissions should be forwarded to the Secretary, Development Appeal Board, Town of Banff, P.O. Box 1260, Banff AB T1L 1A1.
